Welcome to Athlefy.

These Terms of Use ("Terms") govern your access to and use of the Athlefy platform, including our website, mobile applications, dashboards, and all related services.

By creating an account or using Athlefy, you agree to these Terms. If you do not agree, please do not use the platform.

1. Who Can Use Athlefy

You may use Athlefy if:

You are legally allowed to enter into agreements under Egyptian law

You are using the platform for a sports academy, club, or related activity

You provide accurate and complete information

If you are using Athlefy on behalf of an academy or organization, you confirm that you are authorized to accept these Terms on its behalf.

2. What Athlefy Provides

Athlefy is a sports management platform that helps academies and clubs manage:

Attendance tracking

Athlete assessments and performance analytics

Payments, invoices, and financial tracking

Communication with parents and athletes

Team and coach management

Athlefy is a technology platform only and does not act as a financial institution, sports authority, or decision-maker.

3. Your Account

You are responsible for:

Keeping your login details secure

All activity under your account

Managing access for your coaches, staff, and users

You may add or remove users at any time, and you are responsible for their actions on the platform.

4. Data & Privacy

Athlefy processes data in accordance with: Egyptian Personal Data Protection Law No. 151 of 2020

Important:

You are responsible for obtaining parent or guardian consent before uploading any athlete data

This is especially important as many athletes are minors

Athlefy will:

Take reasonable measures to protect your data

Use data only to provide and improve the service

Not sell your data to third parties

5. Payments & Fees

Athlefy may offer:

Subscription plans

Transaction-based fees

Optional paid features

Payments may be processed through third-party providers.

Important:

Athlefy is not responsible for payment disputes between academies and parents

Fees are generally non-refundable — see Section 6 for our full Refund Policy

Additional bank or payment gateway fees may apply

6. Refund Policy

Subscription Fees

Athlefy may issue a refund of subscription fees to an academy upon written request, provided that:

The refund request is submitted in writing to info@athlefyapp.com

The platform has not been used or accessed during the billing period in question

Refunds are evaluated on a case-by-case basis and are not guaranteed. Once the platform has been actively used, subscription fees are considered non-refundable.

Academy–Parent Transactions

Athlefy is not responsible for refunds related to payments made between academies and parents. All such refund decisions are solely at the discretion of the academy. Athlefy acts only as a technology and payment facilitation platform and shall not be held liable for any refund disputes between an academy and its members.

7. Proper Use

You agree NOT to:

Use Athlefy for illegal or fraudulent purposes

Upload false attendance, payments, or performance data

Use athlete or parent data without consent

Attempt to hack, disrupt, or misuse the platform

Share or resell Athlefy without permission

8. Athlete Performance Disclaimer

Athlefy provides tools to support coaches and academies.

We do NOT guarantee:

Athlete improvement

Selection decisions

Performance outcomes

All data and analytics are support tools only.

9. Service Availability

We aim to provide a reliable platform, but:

Athlefy may be updated, modified, or temporarily unavailable

Features may change or be discontinued

We do not guarantee uninterrupted service

10. Account Suspension or Termination

We may suspend or terminate accounts if:

These Terms are violated

Fees are not paid

The platform is misused

You may cancel your account at any time.

11. Intellectual Property

All Athlefy content, including:

Software

Design

Branding

Features

is owned by Athlefy. You may not copy, modify, or distribute any part of the platform without permission.

12. Limitation of Liability

To the maximum extent permitted by law, Athlefy is not liable for:

Data entered incorrectly by users

Payment issues between academies and parents

Loss of revenue or business decisions

Third-party service failures

Temporary service interruptions

13. Chargebacks and Payment Disputes

Definition of Chargeback A "chargeback" refers to any reversal of a payment initiated by a parent or cardholder through their bank, payment provider, or financial institution.

Academy Responsibility The academy acknowledges and agrees that it is the sole merchant of record for all transactions conducted with parents through the Athlefy platform. Accordingly, the academy bears full responsibility and liability for all chargebacks, disputes, refunds, and related claims initiated by parents.

Athlefy's Role Athlefy acts solely as a technology and payment facilitation platform and shall not be held responsible for any chargebacks or payment disputes arising between academies and parents. Athlefy is not liable for the outcome of any dispute investigation conducted by banks or payment providers.

Chargeback Fees and Penalties Any chargeback fees, penalties, or associated costs imposed by payment gateways (including but not limited to Paymob, PayTabs, or other providers) shall be fully borne by the academy. Athlefy reserves the right to deduct such amounts from any settlements due to the academy or request immediate reimbursement.

Evidence and Cooperation The academy agrees to promptly provide all required documentation and evidence (including attendance records, invoices, agreements, or communication history) necessary to respond to chargeback claims. Failure to provide adequate evidence within the required timeframe may result in automatic loss of the dispute, for which Athlefy bears no responsibility.

Right to Withhold Funds Athlefy reserves the right to temporarily withhold or delay settlements to the academy in the event of:

Pending chargeback investigations

Excessive chargeback ratios

Suspected fraudulent or high-risk activity

Excessive Chargebacks In cases where an academy exceeds acceptable chargeback thresholds as determined by Athlefy or its payment partners, Athlefy reserves the right to:

Suspend or terminate the academy's access to payment services

Impose additional monitoring or reserve requirements

Take any necessary action to mitigate financial or reputational risk

Indemnification The academy agrees to indemnify and hold Athlefy harmless from any claims, losses, liabilities, or expenses arising from chargebacks, disputes, or fraudulent transactions related to the academy's activities.

14. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on this page. Continued use of Athlefy means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes shall be subject to the jurisdiction of Egyptian courts.
